Why a bond may be required

Medicare enrollment rules generally require DMEPOS suppliers to post qualifying surety-bond evidence unless the supplier satisfies a specific regulatory exception. The bond and supplier identity must align with the enrollment record and applicable location or NPI structure.

Possible exceptions require verification

Regulatory exceptions may apply to certain government-operated suppliers, qualifying orthotic or prosthetic practices, physicians or nonphysician practitioners furnishing only to their own patients, and qualifying physical or occupational therapy practices. Each exception has conditions. Verify the current rule and facts with the enrollment contractor rather than assuming an exception.

Bond administration controls

  • Keep the bond principal, legal business name, NPI, and location information consistent with enrollment records
  • Submit the required bond documentation through the applicable enrollment process
  • Maintain continuous coverage while the requirement applies
  • Track renewal, rider, cancellation, and replacement dates centrally
  • Investigate notices from the surety or enrollment contractor immediately
  • Reverify an exception whenever ownership, professional status, products, or operations change

Cancellation or lapse risk

A cancellation, lapse, mismatch, or lost exception can affect enrollment. Do not wait for revalidation to reconcile bond records. Confirm required notices, replacement timing, and contractor instructions from current official sources.

Questions to ask a bond provider

  • Is the provider authorized to issue the required federal surety-bond form for this supplier?
  • How will the legal entity, NPI, location, and obligee be shown?
  • What underwriting documents and ownership information are required?
  • How are riders, renewals, cancellations, and notices handled?
  • What changes require a replacement bond or endorsement?
  • What proof will be available for the enrollment submission and future audit trail?
